Let me join legions of Kenyans in congratulating David Maraga the incoming Chief Justice of the Republic of Kenya. I will be remissed if I didn’t mention that we (Kenyans) are a highly partisan lot, we see everything through the prism of political (read tribal) affiliation.
This means that the CJ designate’s judicial pedigree will certainly be a specimen in the political laboratory for political junkies to examine.
His position on issues like habeas corpus ( given the government’s cavalier crackdown on dissenting voices) will certainly be viewed from a partisan political vantage point.
We are less than a year away from the 2017 polls and the infamous Mutunga ruling is still fresh in the minds of many Kenyans. How this new CJ handles a hot button issue like stare decisis will also give political talking heads more to chew on.
I wish him all the best, but I am also not holding my breath for any rocket-launching supreme court jurisprudence.
