WHY THE PRESIDENT’S INTERVENTION IS GOOD IN FIGHTING CARTELS AND CORRUPTION.
In my long experience fighting cartels, I have seen cartels gang up and use all smear campaign methods to scandalise you with non-issues so that you look like a worse CARTEL than even them. In particular, cartels are known to introduce diversionary tactics through unnecessary wars to divert the attention of the public. Not that I care, they can take this to their graves that uwongo ni mfupi sana haulast.
For instance in the on going construction of Dandora Stadium, the county has so far paid 96M to the Contractor as per the payment vouchers and the certificates raised on the works done so far but Cartels have given the media an exaggerated figure of 196M just to scandalise this important project of constructing 4 major stadiums for the great people of Nairobi to stall it because during their time they never dreamt of such mega projects which will go a long way in changing the lives of Nairobians.
Good thing about the President when fighting cartels and corruption he would not spare anyone in any position including myself, any of his Cs’s or relatives. I remember sometime back on Friday 18th December, 2015 a powerful cartel of Pakistan origin by the name of Shital had grabbed a huge public land including houses and an underground water reservoir tank (which was supplying water to the residents of Nairobi) belonging to Nairobi water company in Loresho. He had started constructing a mall on the land with full assistance of the area former OCS. (Now transferred and later sacked).
When the matter was brought to my attention by Loresho Residents Association and I started pursuing the repossession of this land, a senior officer in the previous county administration was sent by the grabber to bribe me so that I dont pursue the case further. I Reported to EACC and he was arrested.
When EACC team led by Madam Judith Shamala went to the land they were chased away by hired masai morans from a neighboring country who had been hired to guard the land armed with matchetes, bows and arrows. When I received these unfortunate news of the impunity, I also visited the land still nikatolewa mbio coz the guards out-numbered my officers.
My first stop from there was Statehouse. I explained the incident to the President and the following Monday morning on 22/12/2015, he send me a big back up team which comprised of the former Inspector General of Police Joseph Boinet, Former Director of Criminal investigations Muhoro Ndegwa, Former Deputy Inspector General of Police Joel Kitili, Former National Lands Commission Chairman Mohammed Swazuri and Former EACC CEO Halake Wako and a huge contigency of law enforcement officers as evident in the attached video clip.
All the hired masai morans were rounded up and arrested that day and the construction of the mall on public land stopped and land riverted back to the public to this day.
In my next video update, I will expose the issue I raised yesterday on how another powerful grabber is demanding to be compesated kshs 19,000,000,000/= (19B) on a public land that was allocated for public use through a motion passed by parliament on Wednesday, 23/7/1997 in a motion moved by Hon. Henry Ruhiu former Embakasi Mp (Ford Asili). He was supported by former Langata Mp Hon. Raila Amollo Odinga (NDP), former Kisumu rural Mp Hon. Prof. Anyang Nyong (Ford K) among other MPs. Assistant minister Boaz Keino also supported the motion on Government’s side.
The Land Grabber was awarded the Ksh 19Billion compesation by Justice Odunga on 15/12/2017 from 6B that had been first awarded by Justice Nambuye on 12/10/2012 vide case No. 876 of 2004 even while our appeal was pending. We put up a very spirited fight at the Court of Appeal through the AG and on 22/3/2019 both the 6B and 19B awards were set aside by Justices E.M GITHINJI, F. SICHALE & S. OLE KANTAI vide court of appeal civil appeal no. 32 of 2014 but nobody is talking about it today because of the of money.
However, through Corruption and Cartels the Court of Appeal file was hidden immedietely after the judjement and the grabber went ahead to mislead the Millimani Chief Magistrate’s Court and on 14/4/2019 the grabber was granted an eviction and demolition order of evicting over 200, 000 residents of Mukuru kwa Njenga vide case 1257/2018.
Immedietely, through the County Government of Nairobi we hurriedly moved to court again vide the same court file and got a temparary stay pending the hearing and determination of our case to stop the eviction exercise on 24/5/2019. After full hearing of the case, we won and the eviction and demolition orders were vacated and set aside permanentely on 16/8/2019.
It is also good to note that when the President visited Mukuru kwa njenga on 13/1/2015 he gave a presidential directive and instructed the land should rivert to public use for settling mukuru residents and constructing public utilities like schools, markets hospital, etc. On 19/5/2015 the then chief of staff Head of Public Service Joseph Kinyua wrote to the late Lands Ps Madam Mariam El Maawy directing her to effect the Presidential directive of settling the squarters vide a letter dated 19/1/2015 reference no. OP/CAS/26/1/3A and also copied to Monica Juma who was the then Principal secretary interior.
On 29/1/2015, Senior deputy secretary ministry of lands W. Baraza wrote an internal memo to Secretary of Lands advising him and the PS and CS Lands to constitute a committee to look into the matter but to date nothing has been done only the grabber has been paying frequent visits to the Ministry of Lands pushing for 18B tax payers money to be paid to him.
