Velvine Nungari case:
What constitutes murder? Among them is Malice aforethought which is the premeditation, a mind to kill, an act done outrightly to kill;
An Intent to kill, an intent to cause grievous bodily harm that may cause death or an intent to commit other felonies through causing harm.
Was the death of this innocent lady a premeditated murder? May be, may be not.
Exactly 10:09 PM, February 23rd 2021 CCTV cameras at Sinnot Hotel capture Velnine Nungari and Murimi booking a room.
Last traceable moments show they were from another hotel -Red Oak Hotel where they had taken super.
Velnine and Murimi are captured already getting cosy with each other at the reception, moderately intoxicated but sober.
Velvine seen sipping what is assumed to be bottled water (1ltr) while at it. (Toxicology Report ought to reveal all contents in her body).
They together head for Room “Zambia” upstairs after paying and recording all their particulars at the reception.
Murimi recorded his Phone Number, ID Number and his names.
The ID number of the lady was also taken.
Quite a thorough hotel, Others should take cue.
What happened in the room is not known but reconstruction of the crime scene can help.
Some say, rape happened.
So, What constitutes Rape?
A person commits the offence termed rape if –
(a) he or she intentionally and unlawfully commits an act which causes penetration with his or her genital organs;
(b) the other person does not consent to the penetration;
(c) the consent is obtained by force or by means of threats or intimidation of any kind or any other coercive means including drugging.
Penetration using genital organs happened, was it intentional? The answer definitely is yes, he intended to have sex with the lady.
Did the lady give consent? We don’t know, if she didn’t give consent it becomes rape.
Was consent obtained through force?
Defensive wounds would show in an autopsy.
A reconstruction of the scene would show struggle.
Was the consent give unconsciously through drugging?
Toxicology report would show levels of foreign content in the blood.
Was consent given through threats or intimidation? That one would be hard to prove unless the lady reported so.
Murimi left the room and reported to the reception an hour and a half later.
He informed the management that he was leaving for home and reminded John Maina the hotel manager that he was a married man. (Murimi is a frequent visitor in the hotel as per the recording by the hotel management).
He said he had left the lady to rest.
He took Velvine’s phone with him, the question is Why?
The next day on 24th February 2021, afternoon, Velvine called a friend at the hotel requesting to be taken to hospital, she was in bad condition from backache and abdominal pain.
The hotel management called Murimi, who came back from his Kirigiti homd and they together with Velnine friends took her to KU Hospital using a cab and she was admitted and diagnosed with a collapsed vertebral bone injuring her spine and injuries on the cervical bone.
After treatment for days, she succumbed to the spine injuries on March 9th.
The big questions remain;
Under what circumstances did Velvine get an injury that caused her vertebral bone to collapse touching her spine?
My reconstruction after the facts suggest she might have been pulled from her shoulder from behind causing pressure on her back.
Maybe from an intense penetration from the back.
Could it have happened intentionally? Yes and no.
People engage in all manner of styles, others can have ulterior motives.
Worth noting; Contrary to earlier reports on the media that the lady could have been drugged, my source informs me that the toxicology report show otherwise.
Autopsy report only revealed injuries causes by pressure on her back and injuries on her cervix as a result force, maybe from avery rough penetration.
Is it case of a manslaughter?
The case OB Number: 59/24/02/2021 is a case still open.
May justice for Velnine be found.
