Supreme Court Proceedings: The Most ‘Stupid’ Argument of the day was by IEBC on Forms 34A and 34B

Date:

@IEBCKenya’s argument through Nyamodi is that since the Court of Appeal affirmed presidential results announced at the polling station and at the constituency tallying center are final, IEBC just received forms 34B’s and announced presidential results without verifying with forms 34As.

The argument is that constituency returning officers had no obligation to verify results transmitted to constituency tallying centers with form 34As before generating form 34Bs.

IEBC is basically arguing that even if individual form 34As are proved to be inconsistent with results submitted on 290 form 34Bs to the National Tallying Center, it was none of their business based on the court of appeal ruling.

Somebody tell counsel that IEBC is not just Chebukati and Chiloba BUT everybody who was involved and had authority to act on behalf of the commission, be a clerk, a deputy presiding officer, presiding officer, Constituency returning officer, county returing officer the commissioners and both junior and senior staff of the secretariat headed by Chiloba.

As for Counsel Muite, here is what bad ass blogger Jim Bonnie had to say:
I love Muite. He still mean well for this country. He fought alongside Orengo and Raila for second liberation. He knows results were stolen, he knew he couldn’t properly respond to NASA submissions. He didn’t want to lie. He knows IEBC has presented fake forms to the court. He feels the guilt of betraying the people of Kenya. So he stood up, stressed on the sovereignty of the people of Kenya in Article 1 of the Constitution and quoted a bible verse, looked at Orengo, then at Raila then enlarged his big eyes to scare judges then rushed to sit leaving the pan for Nyamodi to fry himself. Folks, prepare your ID cards.
