A Nairobi court yesterday acquitted controversial blogger Robert Alai who is accused of posting an offensive message on social media. The message said EACC boss Halakhe Waqo got his job using a forged University of Nairobi degree.
Senior principal magistrate Joyce Gandani discharged Alai following an application by prosecutor Duncan Ondimu that Director of Public Prosecutions Keriako Tobiko wishes to withdraw the case under Section 87(a) of Criminal Procedure Code. Ondimu told the court that the DPP made the decision, following the recent ruling by High Court Judge Mumbi Ngugi that the section is no longer operational.
The magistrate allowed the prosecution’s request and acquitted Alai. In January, Alai was arraigned before Milimani chief magistrate Daniel Ogembo. He denied posting on his Twitter account a message with an intent to annoy Waqo regarding his education credentials.
