Raphael Tuju has fired back at the Judiciary and the East African Development Bank (EADB), accusing them of blatant collusion and a desperate attempt to silence him.
In a strongly worded statement, Tuju exposed how the Judiciary and EADB released near-identical press statements—proof, he says, of a coordinated effort to manipulate public perception and frustrate his legal battle.
Judiciary and EADB’s Coordinated Attack
- The Judiciary and EADB released statements that were strikingly similar, raising serious concerns about independence and impartiality.
- Tuju called out the Judiciary for failing to reprimand Supreme Court judges who had publicly discussed the ongoing case, yet now seek to punish him for merely responding.
- He vowed to respond in full during today’s court hearing at Milimani.
“Why is the Judiciary siding with EADB in a private dispute? Since when did courts start issuing statements defending financial institutions?” Tuju asked.
EADB’s Shaky Legal Ground
- Tuju pointed out that EADB’s Kenya Country Manager had recanted affidavits used against him in the UK and Kenyan courts.
- One of EADB’s staff members is facing criminal charges for submitting false affidavits to the DCI.
- The High Court in Machakos ruled on March 20 that the EADB Act of 2014 was unconstitutional—legislation that Tuju says the bank has abused to oppress Kenyans.
“EADB has been using an illegal law to terrorize people like me,” he stated.
He also reminded Kenyans that former Attorney General Githu Muigai, who pushed the EADB Act through Parliament, is now representing the bank in court—a glaring conflict of interest.
Judiciary’s Silence on Corruption and Injustice
- Tuju took issue with Judiciary spokesperson Paul Ndemo, questioning why the Judiciary had not updated Kenyans on the case of Kenneth Ali Kibiria—the man who set himself on fire outside the Supreme Court due to frustrations with the legal system.
- “You promised an update. Where is it?” Tuju demanded.
- He accused the Judiciary of attempting to gag the press while ignoring more pressing issues, like judicial corruption and inefficiency.
Media Control and PR Manipulation
Tuju also blasted EADB’s history of media influence:
- The bank hired a major PR firm to control the narrative since 2019, often getting favorable coverage.
- Now that they are losing ground, they are crying foul and trying to suppress negative press.
“What changed? Why is EADB suddenly afraid of the media?” he questioned.
Today’s Court Battle: Tuju Stands Firm
Tuju is set to appear in court today alongside Senior Counsels Nelson Havi and Ahmednassir Abdullahi. Their legal battle is no longer just about land—it’s about fighting judicial overreach and corporate interference in Kenya’s justice system.
