ANY OF THE IEBC OFFICIALS MAY STILL BE INVESTIGATED AND PROSECUTED FOR THE 2017 PRESIDENTIAL ELECTION-RELATED ACTS AND OR OMISSIONS
While the SCOK may have absolved individual commissioners from criminal culpability, nothing stops the ODPP and the DCI from investigating the officers and prosecuting those found criminally culpable. The SCOK pronouncement does not act as a bar to criminal investigation and or prosecution.
The SCOK sat as an election court in which the standard of proof as held in Raila 2013 (and confirmed by Raila 2017) is below the “beyond reasonable doubt” which is the test for criminal liability
